1. Acceptance of Terms
By accessing, registering for, or using Fundifine (including any related websites, dashboards, APIs, mobile interfaces, or services), you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.
If you do not agree to these Terms, you must not access or use the platform. If you accept these Terms on behalf of a Direct Selling Agent (DSA) firm, company, or other organisation, you represent that you have authority to bind that entity, and “you” includes that entity.
Continued use of Fundifine after any update to these Terms constitutes acceptance of the revised Terms.
2. Description of Service
Fundifine is a B2B Software-as-a-Service (SaaS) Customer Relationship Management (CRM) platform designed for loan DSAs and their authorised staff to manage leads, loan applications, KYC-related workflows, applicant records, and related operational processes.
Fundifine may also facilitate access to certain paid third-party API services (for example, credit bureau reports and Income Tax Return (ITR) data retrieval) that are triggered by authorised DSA users in connection with loan origination and processing.
Fundifine is not a bank, Non-Banking Financial Company (NBFC), lender, credit information company, or loan product provider. We do not originate loans in our own name, approve or reject loan applications, set lending criteria, or guarantee funding outcomes. Any credit, underwriting, or disbursement decisions are made solely by the relevant lenders, NBFCs, or financial institutions with which you or your applicants deal.
3. Eligibility & Account Registration
Fundifine is intended solely for authorised business users in the following roles:
- DSA Staff — operational users of a registered DSA;
- DSA Admin — administrators managing a DSA organisation’s account, staff, and wallet;
- Super Admin — platform administrators operated by Fundifine.
End loan applicants / borrowers do not create accounts or log into Fundifine. Applicant information is entered and managed by DSA users on behalf of their customers.
You represent and warrant that: (a) you are legally capable of entering into binding contracts; (b) the information you provide during registration and use is accurate and complete; (c) you will keep credentials confidential and not share login access; and (d) you will promptly notify us of any unauthorised use of your account.
We may refuse, suspend, or limit registration or access where we reasonably believe eligibility requirements are not met or these Terms may be breached.
4. DSA Responsibilities
As a DSA Admin or DSA Staff user, you are solely responsible for:
- Ensuring that all applicant and customer data you enter into Fundifine (including PAN, Aadhaar, contact details, financial information, and documents) is accurate, complete, and lawfully obtained;
- Obtaining all necessary rights, permissions, and informed consent from the end applicant before collecting, entering, storing, or processing their personal data on the platform;
- Ensuring that any bureau pull, ITR download, KYC check, or other paid API action is triggered only for a legitimate loan-processing purpose and only after required applicant consent has been obtained (including OTP-based consent where applicable);
- Complying with all applicable laws, including data protection, KYC/AML, and fair lending or intermediary regulations that apply to your DSA business;
- Supervising staff access, maintaining appropriate internal controls, and ensuring wallet and API usage aligns with your organisational authorisations;
- Not using Fundifine for unlawful surveillance, identity misuse, fraud, spam, or any purpose unrelated to legitimate DSA loan origination and servicing workflows.
You acknowledge that Fundifine relies on data and instructions provided by DSA users and does not independently verify the authenticity of every applicant record entered by you.
5. End-Applicant Data & Bureau / Credit Report Consent
Where Fundifine is used to retrieve credit bureau reports, ITR data, or similar third-party information, the following applies:
- Such retrieval is initiated by an authorised DSA user on behalf of the applicant, not by the applicant logging into Fundifine;
- Before any credit bureau (or similarly regulated) pull, the platform is designed to capture OTP-based consent from the applicant’s registered mobile number;
- Applicant personal data and retrieved reports/data are to be used solely for legitimate loan processing and related DSA operational purposes connected with the applicant’s request or application;
- You must not use bureau/ITR outputs for employment screening, unrelated marketing, resale, profiling outside loan processing, or any purpose not permitted by law or the relevant third-party vendor terms;
- Data should not be stored, retained, exported, or shared beyond what is reasonably necessary for the stated loan-processing purpose and applicable legal retention requirements.
You remain responsible for ensuring that the mobile number used for OTP consent belongs to the relevant applicant (or is otherwise lawfully authorised for consent capture) and that the applicant understands the nature of the data pull being requested.
Third-party API vendors (for example, credit bureau aggregators or ITR data providers) process data under their own terms and technical/security controls. Fundifine does not control those vendors’ systems and is not liable for their independent acts or omissions except to the extent required by applicable law.
6. Data Privacy & Security
Our collection, use, storage, and disclosure of personal data in connection with Fundifine is described in our Privacy Policy (separate page). By using the platform, you also agree to the practices described there.
We implement administrative, technical, and organisational measures designed to protect platform data. However, no method of transmission or storage is completely secure, and you use the platform understanding residual risk.
DSA organisations act as controllers (or equivalent) of applicant data they upload; Fundifine processes such data to provide the CRM and related services. You must ensure your own privacy notices, consents, and retention practices toward applicants comply with applicable law.
7. Intellectual Property
Fundifine, including its software, UI, logos, trademarks, documentation, workflows, and underlying technology, is owned by Fundifine or its licensors and is protected by intellectual property laws.
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the platform solely for your internal DSA business purposes. You may not copy, modify, reverse engineer, resell, sublicense, or create derivative works from the platform except as expressly permitted by law or written agreement.
Applicant data and content you lawfully upload remain subject to your and the applicant’s applicable rights; you grant Fundifine a licence to host, process, and display that content as needed to operate the service.
8. Limitation of Liability & Disclaimer
Fundifine is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we disclaim all warranties, whether express, implied, or statutory, including merchantability, fitness for a particular purpose, and non-infringement.
Without limiting the foregoing:
- Fundifine is a CRM / workflow tool and is not responsible for loan approval or rejection decisions made by lenders, NBFCs, banks, or other financial institutions;
- We do not warrant uninterrupted availability, error-free operation, or that third-party API outputs (bureau scores, reports, ITR data, etc.) are complete, current, or suitable for any particular lending decision;
- We are not liable for losses arising from inaccurate applicant data entered by DSA users, missing or invalid consent, misuse of credentials, or your failure to comply with law;
- To the maximum extent permitted by law, our total aggregate liability arising out of or relating to these Terms or the platform shall not exceed the fees actually paid by you to Fundifine for the wallet/API services giving rise to the claim during the three (3) months preceding the event, or such other minimum amount as mandatory law requires;
- We shall not be liable for indirect, incidental, special, consequential, punitive, or lost-profit damages, even if advised of the possibility of such damages.
9. Indemnification
You agree to indemnify, defend, and hold harmless Fundifine, its directors, officers, employees, and agents from and against any claims, losses, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:
- your use of Fundifine;
- applicant data you collect, enter, or process;
- failure to obtain valid applicant consent (including OTP consent);
- your breach of these Terms or applicable law;
- disputes between you and applicants, lenders, NBFCs, or other third parties; and
- unauthorised or fraudulent use of your account or wallet.
10. Account Suspension / Termination
We may suspend, restrict, or terminate your access (in whole or in part) immediately, with or without notice, if we reasonably believe that:
- you have breached these Terms or applicable law;
- your account poses a security, fraud, or compliance risk;
- required fees or wallet obligations are unpaid or disputed in bad faith;
- you misuse third-party API services or applicant data; or
- continued access could harm Fundifine, other users, applicants, or vendors.
You may stop using Fundifine at any time. Upon termination, your right to access the platform ceases. Provisions that by nature should survive (including intellectual property, limitation of liability, indemnification, and governing law) will survive termination.
